Banana100 reserves the right to modify, suspend, or discontinue any aspect of our services at any time without notice.
When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding your account and for all activities that occur under your account. You must be at least 18 years old or have the consent of a parent or guardian to use our services.
- Credits: Our services use a credit system. Credits are required for both image and video tasks.
- Free Credits: New users receive complimentary credits to explore our services.
- Free Credits Expiration: Free credits expire one month after issuance and do not roll over.
- Subscription Credits: Monthly and annual plans receive credits monthly from the subscription start date. The allocation depends on the plan tier.
- Credit Expiration (Subscriptions): Monthly credits issued under subscriptions expire one month after issuance and do not roll over.
- Credit Packs: One‑time credit packs are valid for 100 years from the purchase date.
- Payment Processing: Payments are processed by third‑party providers. You agree to provide accurate billing information.
- Subscription Scope:
- One‑time credit purchases can coexist across multiple payment providers.
- Only one active subscription (
active or past_due) is allowed per account across all providers.
- Provider Differences:
- Subscription management capabilities vary by payment provider and may change over time.
- Some providers may support plan upgrades/downgrades and period‑end cancellation, while others may only support immediate cancellation or no plan changes.
- Customer portal availability also depends on provider capabilities.
- Plan Changes:
- Plan change options shown in the product UI are provider‑specific and are the source of truth at the time of operation.
- If a provider does not support a requested change type, you may need to cancel the existing subscription and create a new one after the current subscription lifecycle ends.
- Cancellations:
- Cancellation behavior (immediate vs period‑end) depends on provider capability and the current product flow shown in the billing UI.
- If period‑end cancellation is available, benefits remain until the end of the current billing period.
- If only immediate cancellation is available, access may end sooner according to provider behavior.
- Fair Use: We reserve the right to limit excessive usage that may impact service performance for other users.
- Usage Monitoring: We monitor platform usage patterns to maintain system stability and prevent abuse.
- Content Restrictions: Our AI systems include content filters to prevent the generation of harmful, illegal, or explicit content. Attempting to circumvent these filters is prohibited. If our system detects deliberate attempts to generate illegal content, the credits consumed for such attempts may not be refunded.
Our website and its original content, features, and functionality are owned by Banana100 and are protected by international copyright, trademark, and other intellectual property laws.
- User Uploads: You retain all rights to the images and videos you upload.
- AI‑Generated Media: You receive ownership rights to images and videos generated through our AI services, provided you have valid credits and your use complies with these Terms.
- Commercial License: Generated media includes a commercial license for personal and commercial use.
- License Limitations: You may not:
- Claim generated media was created entirely by humans.
- Resell or redistribute raw generated media as stock assets or training datasets.
- Use generated media for illegal, harmful, or fraudulent purposes.
- Data Retention: Uploaded and generated media are retained based on account type:
- Free: 7 days
- Pro: 30 days
The same retention applies to thumbnails, transcoded artifacts, and associated operational logs.
- Content License (Service Operation Only): By uploading content, you grant us a worldwide, non‑exclusive, royalty‑free license to host, cache, transcode, display, and process your content solely to provide, operate, secure, and support the services (including moderation, abuse prevention, and diagnostics). We do not use your content to train machine learning models.
You agree not to:
- Use our services in any way that violates any applicable law or regulation
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of our services
- Attempt to gain unauthorized access to our servers or networks
- Use our services to distribute malware or other harmful code
- Generate or attempt to generate content that is illegal, harmful, discriminatory, or explicit
- Scrape, data-mine, or extract data from our services using automated methods
- Reverse engineer or attempt to extract the source code of our software
- Use our services to infringe on intellectual property rights
- Share your account credentials with others or allow multiple users to access a single account
- We use automated systems (and, when necessary, human review) to review prompts, images, and videos.
- Content that violates our policies may be blocked or removed.
- Repeated violations may result in suspension or termination.
- We may review user content as needed to ensure compliance.
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms
- Engaging in prohibited activities
- Non-payment of fees
- Extended periods of inactivity
- Upon request by law enforcement or regulatory authorities
- Detection of fraudulent, illegal, or suspicious payment methods
If we detect that you may be using fraudulent, illegal, or suspicious payment methods to purchase subscription plans, we may proactively issue a refund and cancel your subscription without prior notice.
Upon termination, your right to use the services will cease immediately. To request account deletion, please contact support@nanobanana100.com.
In no event shall Banana100 be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. Our total liability for all claims related to our services shall not exceed the amount you paid to us for the services in the preceding three months.
You agree to indemnify and hold Banana100 harmless from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from your use of our services or violation of these Terms.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting the updated Terms on this page and sending an email notification to users where appropriate. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
